FREE 2-LITER CHASE PROMOTION: 2020 TERMS & CONDITIONS
1. The FREE 2-Liter Promotional Offer (“Promotion”): Beginning on March 30, 2020, Sponsor will give away one (1) 2-liter PepsiCo product to each customer who purchases a Qualifying Pizza (defined below) on the Little Caesars mobile app or online at LittleCaesars.com in accordance with these Terms and Conditions (“Terms”). A Qualifying Pizza is defined as any pizza purchased on the Little Caesars app or online (in-store purchases are excluded), except for the Lunch Combo (i.e., 4-slice DEEP!DEEP!™ Dish pizza with Pepperoni and one 20 oz. PEPSI-COLA® product). Only Eligible PepsiCo Products (defined below) are available for redemption under this Offer. To redeem the Offer, customer must (i) obtain a valid promo code (“Promo Code”), which Sponsor will make available on its social media platforms and in its advertising and promotional materials ; (ii) place the 2-liter Eligible PepsiCo product (“Promotional Item”) in his or her cart with his/her Qualifying Pizza purchase; and (iii) enter the valid Promo Code at checkout. Promo Code numbers may vary depending on how they are communicated but each Promo Code will entitle a customer to the same Promotional Item regardless of the Promo Code number. Offer redeemable only with online and mobile app orders and not redeemable on in-store orders or in any manner other than provided herein. OFFER GOOD FOR A LIMITED TIME ONLY.
“Eligible PepsiCo Products” consist of the following products: Regular and Diet brands included for each listed Brand including all other 2-L Brands’ Flavors (for example: Crush Grape): Pepsi®, Pepsi Throwback®, Diet Pepsi®, Pepsi Zero®, Pepsi Max®, Wild Cherry Pepsi® Mountain Dew®, Diet Mountain Dew, Mountain Dew Throwback®, Mountain Dew Code Red®, Mug® Root Beer, Sierra Mist ®, Manzanita Sol®, Lipton® Brisk®, Dr. Pepper®, Crush® brands and Schweppes Brands.
2. Eligibility: Offer good only at participating Little Caesars stores in the fifty (50) United States (and D.C.) (each a “Participating Store”), excluding any stadium, Kmart, Walmart, food truck, Motor City Casino and Little Caesars Express locations. Void outside of the 50 United States and District of Columbia and where prohibited, taxed or restricted by law. Employees, officers and directors of Little Caesars Enterprises, Inc. (“Sponsor”) are not eligible to participate. All federal, state and local laws and regulations apply.
3. Promotional Item: Limit one (1) Promotional Item per customer, per day of the Promotion, regardless of how many purchases are made by that customer on that day. No substitutions or cash redemptions by customer. In the case of unavailability, Sponsor reserves the right (but does not have the obligation) to substitute a Promotional Item of equal or greater value, in its sole discretion. All applicable taxes are the sole responsibility of the customer (if any).
4. General Conditions: Participating Stores each reserve the right in their sole discretion to prohibit admission to and/or not give a Promotional Item to any individual they find to be engaging in fraud or undermining the legitimate operation of this Promotion or acting in an abusive, fraudulent, deceptive or disruptive manner or in violation of these Terms. Any attempt by any person to undermine the legitimate operation of the Promotion may be a violation of criminal and civil law and should such an attempt be made, Participating Stores reserve the right to seek damages from any such person to the fullest extent permitted by law. Each Participating Store reserves the right to make the final decision with respect admission and/or redemption and fulfillment of Promotional Item, in its sole discretion. Not all Little Caesars stores or franchisees participate in this Promotion and Released Parties cannot be held responsible for this decision.
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, extend or suspend this Promotion (in its sole discretion) and without prior notice or obligation in the event of: (i) any virus, bugs, non-authorized human intervention, cheating, fraud or other causes beyond the control of the Sponsor corrupt or affect the administration, security, fairness or proper conduct of the Promotion; (ii) any error, technical problem, fraud or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Promotion and/or any Promo Codes as contemplated by these Terms; and/or (iii) any accident, printing, administrative or other error or any kind. Void where prohibited or expired. Sponsor is not responsible for late, non-compliant or misdirected requests. Requests not complying with all offer requirements will not be honored. Duplicate requests will constitute fraud.
By participating, you agree to release and hold harmless Sponsor, any Participating Stores, other Little Caesars stores (including restaurants) and franchisees, PepsiCo. Inc., Pepsi-Cola Company and its bottlers and their respective parent companies, subsidiaries, affiliates, partners, representatives, agents, successors, assigns, employees, officers and directors (collectively, the “Released Parties”), from and against any liability, loss, claims or causes of action arising out of participation in the Promotion and/or receipt or use of the Promotional Item and/or any Promo Codes, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical, printing, hardware, software, mobile, telephone or other communications malfunctions, errors or failures of any kind, lost or unavailable network connections, web site, Internet or ISP availability, unauthorized human intervention, traffic congestion or failed, incomplete, garbled, jumbled or delayed computer or mobile transmissions which may limit one’s ability to participate in the Promotion; (c) errors in the administration of the Promotion or the processing, fulfillment or redemption of requests, the Promotional Item or any Promo Codes; (d) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Promotion or receipt or use of any Promotional Item; or (e) a store or franchisee’s non-participation in this Promotion or failure to provide the Promotional Item for whatever reason. You further agree that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion and in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages.
5. Disputes: Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of or connected with, the Promotion or any Promotional Items awarded shall be resolved individually, without resort to any form of class action and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan State Court located in Wayne County, Michigan. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by and construed in accordance with, the laws of Michigan, without giving effect to any choice of law or conflict of law rules (whether of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Michigan.
